Protection

Definition: a trade secret is information which (1) is not, as a body or in the precise configuration and assembly of its components, generally known among or readily accessible to persons within the circles that normally deal with the kind of information in question; (2) has commercial value because it is secret; and (3) has been subject to reasonable steps under the circumstances by the rightful owner to keep it secret.

Assignment - licensing: possible.

Remedies for misappropriation: a person whose trade secrets are being infringed upon may institute an action in court for the following: (1) an order for an injunction; (2) a provisional order to prevent unlawful acts or to preserve relevant evidence; (3) damages for compensation; (4) any other remedy the court may consider necessary.

Comments: a more comprehensive law should be passed to offer more protection on trade secrets in Ghana.
