Membership in International Conventions

– The Hague Convention Abolishing the Requirement of Legalization for Foreign Public Documents (Apostille), since March 31, 1979.
– Convention Establishing the World Intellectual Property Organization (WIPO), since March 16, 2000.
– Paris Convention for the Protection of Industrial Property, Stockholm Act, since November 7, 2002.
– WTO’s TRIPS Agreement, since April 26, 2015.
– ARIPO, Harare Protocol on Patents and Industrial Designs, since January 1, 2022.

Filing, Protection

Applicant: any natural person or legal entity.

Applicants not living in the country: must appoint an agent domiciled in the Seychelles.

Novelty: absolute worldwide novelty is required (six months grace period).

Series applications: one design application may comprise more than one design if they belong to the same class under the International Classification.

Filing requirements for an application (to be sent to resident agent):
1. Notarized power of attorney;
2. Name, address, nationality, residence and passport number of the applicant;
3. Name and address of the creator of the design;
4. Title and details of the design;
5. Two-dimensional designs require one or two photographs of graphic representations, three-dimensional designs require one or two drawings or tracings;
6. Classification and list of products to be used;
7. Certified copy of the priority document, if any;
8. A statement justifying the applicant's right to the registration of the design, where the applicant is not the creator.

Examination: as to formalities.

Duration: five years from the filing date.

Extension: possible for two additional consecutive five-year periods.

Renewal grace period: six months with surcharge.

Invalidation: any interested person may request the court to invalidate a design.
