Domain Names

There is no specific government legislation although some regulations on the organization and management of country code top-level domain names do exist. The Brunei Darussalam Network Information Centre also follows its published rules and guidelines, including the "Rules for the Brunei Darussalam Domain Name Dispute Resolution Policy" and "Registration Policies Procedures and Guidelines", which are accessible on their website.

Filing

Country code top-level domain name: .bn

Sub-domains: .com.bn; .org.bn; .net.bn; .edu.bn; .gov.bn

Applicant: individuals and legal entities.

Restriction as to nationality: none.

Local presence: required, but applicant can appoint a local agent.

Domestic trademark right: not required for obtaining domain name registration. 

Domain name can be registered as a trademark: yes.

Filing requirements (to be sent to resident agent):
1.    A letter from the proprietor authorizing the local agent to apply for registration of their domain names in Brunei.

Registration, Protection

Duration: one year.

Renewal/maintenance: one year, renewable.

Dispute about ownership: to be brought before the court. Alternatively, if the registered domain name is under the jurisdiction of the Brunei Darussalam Network Information Centre (BNNIC), any dispute arising may be brought before the Dispute Resolution Centre of the BNNIC as an administrative proceeding, in accordance with BNNIC policies. The dispute will be decided before a panel appointed by the parties to the dispute or the Provider appointed by the BNNIC. Under the BNNIC rules, parties are barred from commencing legal proceedings in respect of domain name disputes that are the subject of any pending administrative proceedings.

Uniform dispute resolution procedure: BNNIC Dispute Resolution Policy (BDRP), BDRP Rules and supplemental rules agreed by BNNIC.
