Designs and Models

Filing

Applicant: the proprietor of the design or the assignee, or all persons participating in the creation of the design or model, or the employer if the creation is a result of an employment contract.

Filing Office: the applications are to be filed at the Registrar’s Office at the Ministry of Trade and Industry.

Novelty: a design, to be registrable, must be new and original and must not have been published or used in any other country of the world. Application should be made before publication, use, or sale of the invention, in any other country of the world, and the application can be accepted only if filed within one year from the date of home or first application.

Classification: International Classification from class 1-32; one application can include more than one design or model provided that they relate to the same class, set, or composition, according to the relevant international agreement.

Priority of home or first filing can be claimed if the application is filed within six months from the date of first filing.

Filing requirements for an application (to be sent to resident agent):
1. Power of attorney, duly legalized up to the Jordan Consulate;
2. Design Form, which proves that the applicant is entitled to file the application, duly notarized and legalized up to the Jordan Consulate;
3. Specimens or representations of the design in triplicate;
4. Full name, address, occupation and nationality of the applicant;
5. Copy of the Certificate of Incorporation of the applicant’s company;
6. A certified copy of the priority document in case of priority;
7. An abstract that describes the use of the design and its novelty, not more than 100 words;
8. Item(s) to which the design is to be applied and material of which it is made;
9. Class(es) in which the design is to be registered;
10. Drawings and tracing must be in ink on paper of a size of 22 x 33 cm.

Electronic filing: available. 

Electronic signatures: are accepted, provided that the original document is legalized as required.

For a change of name:
1. A change of name certificate or a copy of any official document attesting the official change of name, duly certified and legalized up to the Jordan Consulate;
2. Power of attorney in the new name, legalized up to the Jordan Consulate.

For a change of address:
1. Power of attorney with the new address, legalized up to the Jordan Consulate.

Examination, Protection

Examination: applications are examined both formally and substantively and published in the Official Gazette.

Marking: not provided for.

Assignments: partial and/or complete assignment should be recorded in order to be effective.

Licensing: is provided for.

Opposition: the grant of the industrial design or model is advertised in the Official Gazette, and opposition can be filed within ninety days from the publication date (before issuance of the certificate of registration).

Appeal: all decisions issued from the Registrar’s Office are subject to appeal to the Administrative Court. The decision of the Administrative Court is subject to appeal to the Higher Administrative Court.

Delivery of document: the registration certificate is issued in paper format.

Duration: fifteen years from the date of application or priority date if priority is claimed; no extension.

Annuities: no annuity fees due.

Cancellation: to the Administrative Court at any time after registration, the decision of which is subject to appeal to the Higher Administrative Court.

Infringement: actions for infringement can only be brought after issuance of the respective certificates of registration to the competent court.
