New Plant Varieties

– Plant Variety Protection Law No. 24 of 2000, effective since August 8, 2000.
– Implementation Rules No. 76 of 2002, effective since September 28, 2002.

Membership in International Conventions

– International Convention for the Protection of New Varieties of Plants (UPOV), 1991 Act, since October 24, 2004.

Protection

Subject matter: this law shall apply on varieties classified under plant genera or species, which shall be specified in the regulation to be issued in accordance with the provisions of the law.

Applicant: (1) breeder or assignee; (2) the persons participating in its breeding, if it is the result of their joint efforts; (3) first breeder to file an application, if the breeding is independently made by more than one person; or (4) the employer, if the breeding is a result of an employment contract, which requires the employee to accomplish such breeding, unless otherwise stipulated by contract.

Foreigners: applications for foreigners should be submitted through legal representative.

Standards for protection: distinctiveness, uniformity, stability and novelty.

Disclosure requirements: to be specified in the regulation.

Time for filing: one year from first public non-experimental use or sale in Jordan and for more than four years outside Jordan; six-year grace period for sale of trees and vines.

Priority of foreign application can be claimed if application is filed within twelve months from the date of first filing.

Scope of protection: limited to a single plant variety as defined by the description in the application and varieties essentially derived from the single plant variety.

Duration: twenty years or twenty-five years from date of filing for trees and vines.

Annuities: are payable.

Infringement: sale, import, export, delivery, use in producing progeny or hybrid of plant or inducement of same; crop and research exemptions.

Administration by: the Plant Variety Protection Office, Ministry of Agriculture.

Filing Office: the Registrar’s Offices are located at the Ministry of Agriculture.
