The Kazakh Patent Law includes provisions on utility models for a product, method and new use thereof, except for the methods of diagnostic and treatments of humans and animals.

Examination: formal examination; a utility model patent is granted at the risk of the patentee as it concerns the absolute novelty; the possibility of converting a utility model into a patent, or a patent into a utility model is provided.

Patent certificate: is issued in electronic format only; certificates of authorship are issued in paper format.

Duration: five years from the filing date.

Extension of validity: three years on the owner’s request.

Working: compulsory. Lack of working can lead to the granting of a compulsory license, upon a third party’s request, after a four-year period of non-working counted from the publication date.

Working conditions are: manufacture, importation and sales.
