New Plant Varieties

– Royal Decree No. M/27 dated 29/5/1425 A.H. (Law of Patents, Layout Designs of Integrated Circuits, Plant Varieties and Industrial Designs), in force since September 6, 2004. Last amended by Royal Decree No. (M/45) dated 10/03/1445 AH (September 25, 2023), in force since October 3, 2023.
– Implementing Regulations, effective as of December 26, 2004, as amended and effective as of December 20, 2015.

Protection

Applicant: same as for “Patents“.

Foreigners and nationals not living in the country: same as for “Patents“; foreigners must appoint a local agent.

Conditions of protection: new plant varieties are registrable if they are novel, distinct, uniform and stable, and subject to denomination (designate a nomenclature for it).

Novelty: the plant variety shall be deemed novel if, at the date of filing the application or the date of the claimed priority, propagating or harvested materials of the variety have not been sold or otherwise made available to others by the breeder or with his consent, for the purposes of exploiting the variety in accordance with the following: (a) in the Kingdom of Saudi Arabia for more than one year; (b) in other countries for more than four years or, in case of trees, for more than six years.

Beginning of protection: from the date of filing.

Duration: twenty-five years for trees and vines and twenty years for other crops, from the filing date.

Annuities: the same as for “Patents“.
