Membership in International Conventions

– Paris Convention for the Protection of Industrial Property, Stockholm Act.

Protection

It is a violation of the law to disclose commercial or industrial secrets in a way that contradicts with the honest practices of commerce.

Criteria for enforcement: (1) the information as a whole or in the structure containing its peculiarities was generally unknown or non-circulated with those engaging in the commercial or the industrial activity within which scope the information falls; (2) its commercial value stems from its confidentiality; (3) reasonable measures have been taken by its legal possessor to keep it confidential.

Assignment - licensing: possible.

Remedies for misappropriation: any interested person may bring a civil lawsuit to request compensation for the damage that was inflicted upon him as a result of the actions of unfair competition and may stop these actions and he shall have the right to request taking any of the precautionary measures.
