Domain Names

There is no specific legislation on country code top-level domain names.

Filing

Country code top-level domain name: .th (also available in Thai).

Sub-domains: .co.th; .in.th; .ac.th; .go.th; .or.th; .mi.th; .net.th (also available in Thai).

Applicant: individuals and legal entities.

Restriction as to nationality: none.

Local presence: required. The local representative must be a registered entity (a company, a current representative office, or a branch office) which has the same name as the company seeking to register the domain name.

Domestic trademark right: it is not required, to obtain domestic trademark rights, to register a domain name in Thailand. However, in the case where a domain name is derived from a trademark, such trademark must be registered (in any jurisdiction), and such domain name must be identical in all respects to the trademark. Apart from deriving a domain name from a trademark, a domain name can be derived from an organization name or a project name.

Domain name can be registered as a trademark: yes. However, such top-level domain name and/or sub-domain name will be required to be disclaimed because they are considered as non-distinctive elements.

Registration, Protection

Duration: one to ten years.

Renewal/maintenance: one to ten years, renewable.

Dispute about ownership: to be brought before the court.

Uniform dispute resolution procedure: none.
