Definition: information which constitutes an employment, commercial, or banking secret in case when (1) the information has an actual or potential commercial value by virtue of it being unknown to third persons; (2) there is not free access to it on a legal basis; and (3) the holder of the information takes measures for the defense of its confidentiality.

Assignment - licensing: possible within the scope of a franchise agreement. A person provided with such information is obliged to keep it secret.

Remedies for misappropriation: filing a suit before the court.
