Topographies of Semiconductor Products

Protection

Definitions: Semiconductor products: the final of an intermediate form of any product consisting of a body of material which includes a layer of semiconducting material and having one or more other layers composed of conducting, insulating or semiconducting material, the layers being arranged in accordance with a predetermined three-dimensional pattern, and intended to perform, exclusively or together with other functions, an electronic function. Topography: series of related images, however fixed or encoded, representing the three-dimensional pattern of the layers of which a semiconductor product is composed and in which series, each image has the pattern of the pattern of a surface of the semiconductor product at any stage of its manufacture. Producer: physical person or legal entity who has developed the topography on his own costs and risks.

Entitlement to protection: natural persons as producers being a national of or having their habitual residence in one of the member countries of the EEA as well as their successors. Legal entities as producers having a branch in one of the member countries of the EEA as well as their successors.

Filing requirements:
1. Application for registration with illustration of the topography and its intended purpose;
2. Necessary documents to identify the topography;
3. Statement regarding the date of first commercial exploitation of the topography where it proceeds the date of the application for registration;
4. Statement from which arises the entitlement to protection with regard to the nationality or the domicile;
5. Payment of fees.

Registration: the Liechtenstein Trademark Register enters the topography in the official Register as soon as the application is completed.

Scope of protection: the protection includes protection against reproduction, use or importation for commercial exportation of the topography or any copy of the topography. The protection does not include protection against a bona fide purchaser; (the bona fide purchaser can be compelled to pay an adequate remuneration if he has reasonable grounds to belief that the semiconductor product is protected).

Beginning of protection: the protection begins on December 31st of the calendar year in which the topography was registered or first commercially exploited.

Duration: ten years as of the beginning of the protection if the topography is registered; two years if the topography is not registered. In any case, the protection comes to an end fifteen years after its development.

Reproduction: the reproduction of topographies for research work and education purposes is permitted.

Infringement: follows the same rules as for literary and artistic works (refer to Art. 56 to 60 Copyright Law).

Penalties: infringement is also a criminal offense and may be prosecuted by the criminal court upon demand of the infringed creator. follows the same rules as for literary and artistic works (refer to Art. 56 to 60 Copyright Law).

Cancellation: upon application by the creator or upon decision of the competent court.
