Filing, Protection

Applicant: the owner of a granted U.K. patent or a European patent (U.K.). 

Registrable: patents are registered as confirmation of U.K. patents or European patents (U.K.).

Remark on IP implications of the U.K.’s referendum vote of June 23, 2016 to leave the European Union: the U.K.’s position as a contracting State of the EPO is not affected by the U.K.’s withdrawal from the EU, and European (U.K.) patents will continue to be obtainable through the EPO route.

Filing requirements for an application (to be sent to resident agent):
1. Authorization, simply signed;
2. Copy of specification, certified by U.K. Comptroller, with a further copy. If not in English, a translation certified by the Comptroller.

Publication: if the application is satisfactory, the Registrar will advertise it in the Government’s Gazette. 

Opposition: possible within two months of publication.

Duration: expiring with British patent.
