– Registration of United Kingdom Trade Marks Act (Cap 180).

Membership in International Conventions

– WTO’s TRIPS Agreement, since July 26, 1996.
– Convention Establishing the World Intellectual Property Organization (WIPO), since July 4, 2019.

Filing

Applicant: only the owner of a United Kingdom registration. 

Registered user: a registered user in the U.K. may be entered as a registered user in the Solomon Islands.

Filing requirements:
1. Authorization of agent, simply signed;
2. Certificate of the British Registrar and certified representation of the trademark;
3. 10 specimens of the mark.

Protection

Examination: only formal examination.

Kind of property: registration of a mark gives registrant the right to bring an action of infringement for acts done after the date of registration. 

Duration: same as the registration in the United Kingdom.

Renewal: on expiry and renewal of the U.K. registration, the Solomon Island registration has to be renewed.

Assignment: has to be registered.

Cancellation: on request of the registered proprietor, the Registrar has power to cancel the registration of a trademark, or of a registered user thereunder, either wholly or as regards any particular goods. The court has power upon application of any person who alleges that his interests have been prejudicially affected by a registration, to declare on any of the goods mutatis mutandis on which the United Kingdom registration might be cancelled, that the exclusive privileges and rights have not been acquired.
