Filing

Most of the provisions for filing applications for DPR Korea certificates of invention are similar to those for the DPR Korea “Patents of Invention“, but even substances obtained by way of nuclear transformation may constitute subject matters of applications for certificates of invention and there are no government fees for obtaining or maintaining the titles.

Examination and Protection

Most of the provisions for the examination of applications for certificates of invention are similar to those for “Patents of Invention“. One of the main differences between the two titles is that the holder of a certificate of invention does not have patent-like exclusive right to the exploitation of the invention covered by the certificate, but is entitled, in addition to various moral rights, to receive from any natural or legal person who exploits the invention 30% of profits made from the exploitation during the first three years.

Modification of Protection after Granting
