Filing

Applicant: the creator(s) or his assignee. 

Naming of the creator: compulsory. 

Notion of creation: must be new, involve a creative step and be industrially applicable; special appearance to a product of industry or handicraft; serve as a pattern for a product of industry or handicraft; appeals to and is judged by the eye.

Novelty: worldwide novelty.

Classification: international.

Priority: may be claimed according to the Paris Convention.

Filing requirements for an application (to be sent to resident agent):
1. Name, address, nationality and residence of the applicant;
2. Where the applicant is the creator, the request shall contain a statement to that effect, and where he is not, it shall indicate each creator’s name and address and be accompanied by the statement justifying the applicant’s right to the registration of the industrial design;
3. Power of attorney;
4. If the industrial design is two-dimensional, 4 graphic representations or 4 drawings or tracings;
5. If the industrial design is four-dimensional, 4 graphic representations or 4 drawings or tracings of each of the different sides of the design;
6. Specimens shall be of a size not exceeding 20 x 20 x 20 cm. No graphic representation, drawing or tracing of the design shall exceed 10 x 20 cm. Such representations, drawings, tracings, shall be affixed on 4 sheets of hard and durable paper of A4 size. Drawings and tracings shall be in black ink.

Registration, Protection

Examination: only as to formal defect.

Publication: after granting. 

Duration: five years counted from the filing date.

Renewal: may be renewed for two further consecutive periods of five years. Six-month grace period shall be allowed for late payment of renewal fees.

Invalidation: any interested person may request the court or the Registrar to invalidate a design.
