Protection

Definition: a trade secret is a production method, a marketing method, or other technical or business information useful for business activities, which is not known publicly, is managed as a secret, and has independent economic value.

Assignment - licensing: a trade secret may be transferred or licensed by a contract.

Remedies for misappropriation: a trade secret owner may request a court to prohibit or prevent infringement, including the destruction of infringing goods or the removal of facilities provided for the act of infringement. The owner may also claim compensation for damages, and may request a court to take measures necessary to restore the business goodwill. Further, an act infringing a trade secret is subject to criminal punishment. An act infringing a trade secret may be also subject to the Industrial Technology Protection Law, where only with the industrial technology designated by the government to be protected, it may be protected regardless of whether it qualifies the requirements of a trade secret.
