Legal basis: prior to 2019 no specific laws existed, but registration of ownership of patents of invention was possible under the Registration Act, 1909 and the Specific Relief Act Sec. 54 (which makes it possible to obtain an injunction to restrain infringement). In 2019, four new IP laws (Patent Law, Industrial Design Law, Trademark Law and Copyright Law) were promulgated, but are not yet enforced. Trademark Law No. 3 of 2019 came into force on April 1, 2023. Industrial Design Law of 2019 came into force on October 31, 2023. Copyright Law of 2019 came into force on October 31, 2023.

Membership in International Conventions: Myanmar is a member of the WIPO Convention (since May 15, 2001) and the WTO’s TRIPS Agreement (since January 1, 1995).

Note: it is possible to file a Declaration of Ownership at the Registry of Deeds, followed by the publication of a Cautionary Notice in a local newspaper.
