Filing

Definition: by industrial model is meant all plastic forms, whether combined with color or not, and all industrial, commercial or domestic objects or utensils which may serve as types for the production or manufacture of others, and that may differ from their similar in their distinct shape or configuration.

Foreigners: must apply through a duly registered attorney.

Novelty: novelty and originality.

Unpatentable: (1) subject matter not complying with the above definition of a utility model; (2) methods and processes; (3) sculptures, works of architecture, painting, engraving or stamping or any other subject matter of a purely aesthetic character; (4) everything for which no patent of invention can be obtained.

Priority: as for “patents“.

Filing requirements for an application (to be sent to resident agent):
Same as for “patents“. Drawings in triplicate must always be filed.

Examination, Protection

Examination: same procedure as for “patents“.

Duration: ten years beginning from the date of filing; no extension.

Letters Patent: same procedure as for “patents“.
