Industrial Designs

– The Industrial Property Order, 1989 (“The Order”) (Order No. 5 of 1989), effective from May 22, 1989, as last amended by Act No. 4 of 1997.
– The Industrial Property Regulations, 1989 (Legal Notice No. 85 of 1989), in force since January 15, 1990.

Filing

Applicant: the creator or his assignee or successor.

Definition: any composition of lines or colors or any three-dimensional form, whether or not associated with lines or colors, where such composition or form gives a special appearance to a product of industry or handicraft and can serve as a pattern for a product of industry or handicraft but does not include anything in an industrial design which serves solely to obtain a technical result.

Novelty: is destroyed by prior publication in tangible form anywhere in the world or by oral disclosure, by use, or in any other way in Lesotho.

Filing requirements for an application (to be sent to authorized agent):
1. Application form;
2. Statement by creator or his assignee;
3. Power of attorney (notarization and legalization is not necessary);
4. Representations: 4 sets illustrating all relevant views of the article;
5. Priority document for Convention application.

Registration, Protection

Filing date: the Registrar shall accord as the filing date, the date of receipt of the application.

Examination – publication: where the Registrar finds that the design conforms with the relevant provisions of the Order and Regulations, he shall register the industrial design, publish the fact of registration and issue a certificate of registration.

Term: five years from the filing date.

Renewals: for two further consecutive periods of five years, when payment of prescribed fee before expiry of current term is required.

Opposition: no provision.
