Industrial Designs

– Law of the Republic of Uzbekistan on Patents of Invention, Utility Models and Industrial Designs, of May 6, 1994, as amended.

Membership in International Conventions

– Paris Convention for the Protection of Industrial Property, Stockholm Act, since December 25, 1991.
– Convention Establishing the World Intellectual Property Organization (WIPO), since December 25, 1991.
– Locarno Agreement Establishing an International Classification for Industrial Designs, since July 19, 2006.
– The Hague Convention Abolishing the Requirement of Legalization for Foreign Public Documents (Apostille), since April 15, 2012.

Filing

Applicant: individuals or legal entities. 

Foreigners: enjoy the same rights as nationals; must appoint an Uzbek agent. 

Kinds of designs and models: industrial designs and models (or combinations thereof) which are new, original and industrially applicable.

Novelty: the essential features of a new model or design should not be known in Uzbekistan and abroad prior to the priority date.

Not registrable: models and designs resulting from the technical function of the article; which are contrary to the public interest or morality; those related to structural forms, with exception of minor architectural forms; industrial, hydrotechnical and other stationary facilities; printing products as such; articles having unstable shape, such as liquids, gaseous or bulk substance.

Priorities: according to the Convention.

Multiple applications: one design application can comprise an unlimited number of designs if they belong to the same Locarno class. 

Territory covered: the Republic of Uzbekistan.

Filing requirements for an application (to be sent to resident agent):
1. Power of attorney (no legalization): date, place, applicant’s name and address, signatory’s position are required;
2. Photographs and drawings of the model (5 sets) (one of them in electronic form – attachments of e-mail messages);
3. Specification of the model;
4. Priority document (if any);
5. Payment of the official filing fee (must be paid before filing, prepayment without time limitation, and receipt submitted).

Notes: broken lines and surface shadings are not allowed on figures. The number of figures to be filed is defined by the necessity to give the complete appearance of the design.

Electronic filing: available.

For a change of name or address:
1. Certified copy of the document attesting to the change of name or address (no legalization), with the certified translation into Russian, scanned copy is accepted;
2. Power of attorney (no legalization);
3. Payment of the official recordal fee.

Examination Procedure

Examination: a formal examination and a full examination (novelty).

Amendments and corrections: possible; voluntary within two months following the filing date, as well as during the examination (if no essential modifications are introduced). 

Publication: in the Patent Office Gazette, upon payment of a fee.

Protection

Invalidation and license rights are regulated in the same manner as for “patents“. 

Delivery of document: the industrial design patent certificate is issued in paper format only.

Duration: ten years from the filing date.

Extension: additional five years.

Annuities: the first three years of protection are paid with the granting fees. Subsequent periods counted from the filing date (4th, 5th, 6th, 7th, 8th, 9th, 10th).

Annuity grace period: six months. It is possible to renew the validity of the patent within a three-year period as of the date of expiration of its validity due to non-payment of fees. 

Scope of protection: provided only by the design images. The title of the claimed design and the Locarno International Class influence the scope of protection.
