Domain Names

There is no specific legislation on country code top-level domain names. However, certain articles in the Civil Code as well as in the Criminal/Penal Code have been applied in cases of domain name disputes.

The basis thereof are:
– Article 1365 of the Civil Code, which states that: “Every unlawful act causing harm to another person, shall obligate the person whose act(s) has (have) given use to said harm, to compensate for said harm.”
– Article 382bis of the Criminal/Penal Code, which states that: “Anyone who commits a dishonest act to deceive the public or a person with the intention to obtain, maintain or increase profit from trade or industry owned by him or by another person, shall be punished for the crime of unfair competition with a sentence of imprisonment for maximally one year and four months or with a fine of maximally Rp. 13,500, if said act(s) could cause harm to his competitor or the competitor of said other person.”
– Law No. 11 of 2008 concerning Electronic Information and Transactions with its Elucidation of Law No. 11 of 2008 concerning Electronic Information and Transactions.
– Government Regulation No. 82 of 2012 concerning Electronic Systems and Transactions with its Elucidation of Government Regulation No. 82 of 2012 concerning Electronic Systems and Transactions.
– Law No. 25 of 2009 concerning Public Service.
– Law No. 30 of 1999 regarding Arbitration and Alternative Dispute Resolution.
– Law No. 5 of 1999 regarding Anti-Monopolistic Practice and Unfair Business Competition.
– Regulation of the Minister of Communication and Information No. 23 of 2013 concerning Domain Name Management.
– Ministerial Decree of the Minister of Communication and Information No. 806 of 2014 concerning the Determination of the Management Association of Indonesian Internet Domain Name as a Registry of Top Level Domain Name Indonesia.
– Regulation of the Minister of Communication and Information No. 5 of 2015 concerning Domain Name Registrar of State Administrators Institutions.
– Domain Name Dispute Resolution Policy (Version 3.0).

Country code top-level domain name: .id 

Sub-domains/second-level domains: .web.id (web); .sch.id (school); .go.id (government); .net.id (net); .ac.id (academic); .co.id (company); .or.id (others); .mil.id (military); .war.net.id (warnet) 

Applicant: individuals and legal entities.

Restriction as to nationality: none.

Local presence: not required, with the exception of .co.id domain names, where the registrant must be a legal entity registered in Indonesia.

Domestic trademark right: required for obtaining domain name registration if trademark has been registered in Indonesia.

Domain name can be registered as a trademark: yes.

Registration, Protection

Duration: one year.

Renewal/maintenance: one or two years, renewable.

Dispute about ownership: the Indonesian National Internet Registry/Pengelola Nama Domain Internet Indonesia (PANDI) established a dispute settlement forum called Domain Name Dispute Resolution Forum (PPND), or to be brought before the court. 

Uniform dispute resolution procedure: none, but an alternative is available before the PPND.
